Behind on the mortgage in Sacramento: options to avoid foreclosure now

If you’re behind on the mortgage or the HOA dues, the first thing to do is open the mail and figure out exactly where you stand. Sounds simple, but a lot of people stop opening envelopes when money gets tight. Don’t do that. You need to know who is owed what, and whether you’re looking at a lender problem, an HOA problem, or both. Those are different animals, and they move on different tracks.

Then call the people you owe. Call your loan servicer and ask what options exist for someone in your situation. Ask specifically about loss mitigation, which is the umbrella term for the ways a servicer can work with you. For the HOA, call the management company or the board and ask what the delinquency process looks like and whether a payment plan is possible. Get names. Write down what you’re told and when. Keep it calm and factual, even if the person on the other end isn’t helpful.

Start gathering paperwork now, before anyone asks. Pay stubs, bank statements, a household budget, the mortgage statement, the HOA statements, any letters you’ve received. If you end up applying for help, you’ll need this anyway, and having it ready makes you look serious rather than desperate.

Expect notices. From the mortgage side, the early ones are usually reminders and then a formal notice that you’re in default. In California the foreclosure process has its own sequence of recorded documents and mailed notices, and the timing depends on your loan and your situation, so don’t rely on a neighbor’s story about how long it took for them. From the HOA side, expect letters, then possibly a collection or lien process, and HOA rules and timelines vary by association and by what your governing documents say. Read every notice for what it actually demands and by when.

Acting early matters because options shrink as time passes. A servicer is generally more flexible before a formal foreclosure process is underway. An HOA board is usually more willing to set up a plan before things escalate to attorneys and liens. Waiting doesn’t make the problem smaller. It makes the menu of solutions shorter.

If the numbers are complicated, or you’re not sure what you can afford, talk to a HUD-approved housing counselor. That’s free or low cost, and they know the local landscape. If there’s tax fallout from anything you do, or you’re considering selling or a short sale, talk to a CPA and a lawyer. If you’re unsure about your rights or what a notice legally means, get a lawyer. And if you’re worried about property taxes or county programs, call the county directly rather than guessing. None of this is a substitute for advice about your specific situation, because what applies to you depends on your loan, your HOA, your income, and your paperwork.

There is a fuller write-up at catching up on a late mortgage.
